Terms and Conditions
1. Scope
These General Terms and Conditions (GTC) apply to all services provided by Kim Widlicki through Chara Presentations, including team workshops, one-on-one coaching, slide reviews, and Canva training. By booking any service, you agree to these terms.
Should any provision become invalid, the remaining provisions remain in effect. Changes to these terms require written agreement.
All services are conducted in English, French, or German, as agreed upon booking.
2. Services Offered
Chara Presentations offers:
Team workshops on presentation skills
One-on-one presentation coaching
Slide review and feedback services
Canva training workshops
A first introductory meeting is free and non-binding for both parties. If both parties agree to work together, a written offer will be provided. Acceptance of the offer by the client constitutes a binding contract.
3. Service Changes
Services may be adjusted by mutual agreement. If adjustments result in a significant reduction of originally agreed services, the parties will agree on appropriate compensation for lost revenue.
4. Booking and Payment
Payment methods: Bank transfer (e-banking), TWINT, or other agreed methods.
Payment terms:
Team workshops: Invoice sent after delivery, payment due within 30 days
One-on-one coaching: Invoice sent after each session, payment due within 30 days
Slide reviews: Invoice sent after completion, payment due within 30 days
Canva training: Payment terms agreed upon booking
5. Cancellation and Rescheduling
Team Workshops:
Workshops may be rescheduled by mutual agreement
If the client cancels the workshop entirely, Chara Presentations is entitled to compensation for:
Work completed up to the point of cancellation (preparation, materials created)
Any non-refundable expenses incurred (venue bookings, materials ordered, etc.)
One-on-One Coaching:
Sessions must be cancelled or rescheduled at least 24 hours in advance
Late cancellations or no-shows will be counted as a used session
Coaching packages are non-refundable but sessions may be rescheduled
Slide Reviews:
Reviews must be cancelled or rescheduled at least 24 hours in advance
Late cancellations: Payment may still be required if work has been completed
Canva Training:
Cancellation and rescheduling terms agreed upon booking
To cancel or reschedule: Send an email to kim@charapresents.com with your full name, service booked, and date.
If Chara Presentations cancels a service for any reason, the client will receive a full refund or the service will be rescheduled at no additional cost.
6. Client Responsibilities
The client is required to cooperate to ensure the work can be completed properly. This includes:
Providing necessary information and materials (briefing) completely and on time
Informing Chara Presentations of all relevant circumstances, even if they become known during the project
Arriving on time for scheduled sessions
Having necessary technology and internet connection for online sessions
If the client fails to meet these obligations, Chara Presentations may adjust deadlines and request compensation for additional costs incurred.
7. Confidentiality
All client materials, presentations, and discussions shared during coaching sessions remain confidential. Chara Presentations will not share client information or materials without explicit written consent, except where required by law.
8. Intellectual Property
Client Materials: The client is responsible for ensuring that all materials provided (photos, logos, texts, etc.) do not violate third-party copyrights, trademarks, or other rights. The client holds Chara Presentations harmless from any claims arising from the use of client-provided materials, including legal costs.
Workshop Materials: Handouts and proprietary coaching techniques provided by Chara Presentations remain the intellectual property of Kim Widlicki. Clients may use materials for personal application but may not reproduce, distribute, or sell them without written permission.
Client Presentations: All presentations and materials created by clients remain the property of the client.
9. Liability
Chara Presentations provides professional coaching and training services in good faith. Kim Widlicki is liable only for damages caused by willful intent or gross negligence. Liability for slight or moderate negligence, lack of commercial success, lost profits, or other indirect damages is excluded to the extent permitted by law.
10. Cancellation by Chara Presentations
Chara Presentations may withdraw from the contract if:
The client breaches the terms of this agreement
Fulfillment of services becomes impossible due to reasons attributable to the client
Other important reasons make continuation of the contract unreasonable
In such cases, the client owes payment for services rendered to date plus reimbursement of any expenses incurred.
11. Force Majeure
Chara Presentations is not liable for delays or inability to perform services due to circumstances beyond its control, including but not limited to epidemics/pandemics, government orders, strikes, accidents, or natural events. In such cases, deadlines will be extended accordingly.
12. Client References
With the client's prior written consent, Chara Presentations may use the client's name/company name (including logos) as a client reference for marketing purposes.
13. Severability
If any provision of these terms becomes invalid, the remaining provisions remain in effect. The invalid provision will be replaced by a valid provision that comes closest to the intended purpose.
14. Privacy and Data Protection
Personal data collected through contact forms or email communication (name, email, company) is used solely to respond to inquiries and provide services. Data is not shared with third parties and is stored securely. This website does not use cookies.
15. Jurisdiction and Applicable Law
These terms are governed by Swiss law. The exclusive place of jurisdiction is Basel, Switzerland.
